What Is a Signatory Visa Waiver Program (VWP) Carrier for an ESTA?

signatory visa waiver program carrier for the US ESTA

If you are travelling to the United States under the Visa Waiver Program (VWP) using an approved ESTA, you may come across the term Signatory Visa Waiver Program Carrier. It sounds technical, but it is an important part of travelling to the US without a visa by air or sea.

In simple terms, a Signatory VWP Carrier is a transport operator that has a current agreement with U.S. Customs and Border Protection (CBP) allowing it to transport eligible Visa Waiver Program passengers to the United States.

What Is the Visa Waiver Program?

The Visa Waiver Program allows eligible citizens or nationals of participating countries to travel to the United States for tourism or business for stays of up to 90 days without first obtaining a visitor visa. Travellers must meet the VWP requirements and normally need an approved Electronic System for Travel Authorization (ESTA) before travelling.

An ESTA is a travel authorisation rather than a US visa. Approval allows an eligible traveller to travel to the United States under the VWP and request admission at the border. It does not guarantee entry, as the final admission decision is made by U.S. Customs and Border Protection. Learn more about the ESTA travel authorisation in our guide.

What Does Signatory Carrier Mean?

US law requires carriers transporting travellers who are seeking admission under the Visa Waiver Program to have an appropriate agreement with CBP. A carrier with a current agreement is known as a Signatory Visa Waiver Program Carrier.

CBP publishes a list of carriers with current agreements. The list includes far more than the large scheduled airlines most families will recognise. It can also contain charter operators, private aviation companies and sea carriers.

Why Does the Carrier Matter When Travelling on an ESTA?

Having an approved ESTA does not, by itself, mean you can use any aircraft or vessel to travel to the United States under the Visa Waiver Program.

If you are travelling under the VWP by air or sea, the carrier requirements also need to be met. The US Department of State specifically advises that travellers using a private aircraft or another air or sea carrier that is not VWP-approved as a signatory carrier for the US need to apply for a visa instead.

This distinction is particularly worth checking if your journey involves a private jet, charter flight, smaller airline, unusual ferry or sea operator, rather than a straightforward scheduled flight on a major international airline.

Does an Approved ESTA Mean My Carrier Is Approved?

No. Your ESTA and the carrier’s VWP status are separate requirements.

ESTA is used to determine whether an individual traveller is eligible to travel to the United States under the Visa Waiver Program.

Signatory carrier status relates to the carrier transporting VWP passengers.

You should therefore avoid assuming that ESTA approval automatically confirms that every possible flight or sea journey is suitable for VWP travel.

What If My Carrier Is Not on the Signatory Carrier List?

Do not assume that an ESTA is enough to travel with a carrier you cannot confirm as VWP-approved. The US Department of State says that travellers using a private aircraft or another non-VWP-approved air or sea carrier need to apply for a visa.

If you cannot find your operator, check the exact legal or operating carrier name and contact the carrier for clarification of their signatory carrier status. For immigration advice specific to your circumstances, use official CBP or US Department of State information.

What About Entering the US by Land?

The signatory carrier issue mainly concerns transport by air and sea. VWP travellers can also enter the United States at a land border, but since 1 October 2022 eligible VWP travellers intending to enter by land are required to have an approved ESTA before applying for admission.

If your trip combines flights, cruises, ferries or a land crossing from Canada or Mexico, check the requirements for each part of the journey.

Extra Planning for Autistic and Disabled Travellers

Immigration requirements apply independently of disability or additional support needs. Every traveller using the VWP, including children, needs the appropriate travel authorisation.

For autistic travellers and families, it can help to check immigration documents and carrier eligibility well before departure. Resolving questions in advance can reduce the risk of an unexpected problem at check-in, where an unfamiliar rule or change of plan may add unnecessary stress.

Keep passports, ESTA details and booking information easy to access. I find it helpful to store a backup copy of important travel documents in a dedicated Google Drive folder so I have access to them as long as I have an internet connection. If someone in your group needs airport or airline assistance, arrange that separately with the relevant provider because an ESTA does not record or arrange disability assistance.

FAQ About Signatory Visa Waiver Carriers

What Is a Signatory Visa Waiver Program Carrier?

It is a carrier that has a current agreement with U.S. Customs and Border Protection allowing it to transport eligible passengers seeking admission to the United States under the Visa Waiver Program.

Do I Need a Signatory Carrier If I Have an ESTA?

If you are travelling to the United States under the Visa Waiver Program by air or sea, carrier eligibility matters as well as your individual ESTA approval. An ESTA does not turn a non-approved carrier into a VWP carrier.

Can I Travel to the US on a Private Jet With an ESTA?

Not automatically. The US Department of State states that travellers using a private aircraft or another non-VWP-approved air or sea carrier need a visa. Check the specific operator’s current status before travelling.

Does ESTA Guarantee Entry to the United States?

No. ESTA authorisation allows an eligible traveller to travel under the Visa Waiver Program and request admission. CBP officers at the US port of entry make the final decision on admission.

Where Should I Check the Current Signatory Carrier List?

Use the official U.S. Customs and Border Protection Signatory Visa Waiver Program carrier information. As carrier agreements can change or expire, check the current version close to your journey if your carrier’s status is important to your travel plans.

Which Airline Should We Check if Our Flight is a Codeshare?

Check the airline actually operating the flight into the United States, which may differ from the airline selling your ticket. Look for “operated by” in your booking confirmation. If there is any uncertainty, ask the operating airline to confirm that it can carry passengers under the Visa Waiver Program and check the official CBP information. An approved ESTA does not replace the carrier’s required VWP agreement.

Understanding what a signatory carrier is gives you one more useful check when planning US travel on an ESTA. Alongside each traveller’s eligibility and ESTA approval, confirm the carrier operating your journey if there is any uncertainty, particularly with private aircraft, charter flights or unfamiliar operators.

Sorting this out before travel can help avoid last-minute confusion and make the journey more predictable. For families travelling with autistic children, having the paperwork and travel arrangements checked in advance leaves more time to focus on preparing everyone for the trip.
